I have consulted a lawyer and i have been given the green light by the lawyer who is going to represent me that the remarks Jessimay made in the Cenarius forums is slander and defamation. 3 things she should have never done.
1. Revealed my real name and address
2. Said that i was a pedophile
3. Said that i was a homosexual
The burden of proof will be on Jessimay to prove that i am a pedophile and that i am a homosexual.
The process will go like this. On Monday my lawyer will begin to search for the right venue for me to begin my lawsuit. Once that is determined, a motion willl be made in court to subpoena all chat records by Focus members via Blizzard and everyone who participated in the thread. This will help my lawyer determine the punitive damages to my reputation. The more people who participated and knew of the slander and defamation of me, the higher the amount i will go for in damages. My lawyer says this is a 100% winnable case and there is no fee if he loses.
My proposal:
I will happily go ahead with the above lawsuit if this proposal is not accepted.
I want an apology on the Cenarius forums by Warbarok on behalf of Focus that there were mistakes made in the way Frozzen was guild kicked. You don't have to say anymore than that.
I want a retraction from Jessimay on the Cenarius forums that her statements on my sexuality and her gross lie that i am pedophile were blatant falsehoods and she should have never said that.
I want Hansell and Jessimay removed from the guild. Hansell was the one who provided my personal information and Jessimay was the one who maliciously used it against me.
If the proposal is accepted and carried forth before Monday, May 12, 9:00 AM i will drop my lawyer and lawsuit. You can carry on in peace and i will leave the game
If the proposal is not accepted, I will proceed with my civil action starting on Monday, May 12 at 9:00 AM.
You have plenty of time to think this through.
P.S. I now have a second lawyer willing to take on this case. Free speech does not give Jessimay the right to make criminally liable statements.
